Guantánamo und Abu Ghraib - Fallbeispiele für die Relativierung des humanitären Völkerrechts? Eine Auswertung des Schlesinger Reports

Abstract
The Schlesinger Report documents the latest investigation of American detention
operations in Abu Ghraib Prison in Iraq. The report was released to the public not to
enlighten the individual cases of physical and sexual abuse, but highlight the
responsibilities of the different command levels.
Does the panel under the chairmanship of James Schlesinger find adequate answers
concerning the questions of liability? The author states in her paper that the
Schlesinger commission presents convincing findings on the liability of the military
leadership, but misses to link the abuses in Abu Ghraib to the Guantánamo
precedent.
Both detainee policies mirror the Bush Administrations´ paradigm shift in international
humanitarian law.
